In compliance with the Law 34/2002, July 11, of Services of the Information Society and Electronic Commerce (LSSI-CE), Chargy Technologies, S.L. informs that is the owner of the website www.chargy.com. In accordance with the requirement of the article 10 of the same Law, Chargy Technologies S.L. informs the following data:
The owner of this website is Chargy Technologies, SL with CIF B-87503397 and registered office at Calle Cristobal Bordiú, 13 (28003 Madrid), registered in the Mercantile Registry of Madrid, in volume 34413, folio 179, inscription 1 , sheet M- 619035, (hereinafter "Chargy").
What is the Purpose of this Privacy Policy?
This privacy policy (the "Privacy Policy") aims to inform, clearly and precisely, the users (the "Users") of the Chargy mobile application (the "Application") and the website under the domain name www.chargy.com (the "Website") about the processing of personal data collected, through the Application and the Website, by Chargy Technologies, S.L. and its subsidiaries (hereinafter, collectively "Chargy"), whose identifying data are set forth below.
The Application and the Website respect the User's privacy and protect User information. This Privacy Policy informs about the information that Chargy collects through the provided services, the ways in which it is processed, shared, and protected, and what choices the User has regarding that information.
In the event that the User provides third-party data or shares and/or allows access to such data by other third parties or Users, the User states that they have the consent of those third parties and undertakes to convey to them the information contained in this Privacy Policy, releasing Chargy from any liability in this regard.
Identity and contact details of the data controller
The personal data that we may collect directly from the interested party will be treated confidentially and will be incorporated into the corresponding processing activity owned by Chargy Technologies, S.L.

What information do we collect from Users?
Chargy provides Users with a charging service for their mobile devices through various intelligent charging terminals with monitors ("Battery Sharing Stations") that incorporate 5,000 mAh lithium batteries ("Powerbanks") and that can be located indoors or outdoors.
Our devices may be installed outdoors or in the premises of our clients. Both we and our clients, through surveys or registration forms, may request and collect User data or request their consent for this purpose, in order to use such data for informational, commercial, or advertising purposes about their own products and/or services. During the process, we will clearly inform you of the purposes for which your data will be used and request your consent when necessary.
We collect the following categories of User information: (A) personal identification information; (B) passive information collected electronically, and (C) location information (together, the "Information").
Chargy will anonymize some of the data it collects when using it for various purposes such as market analysis or traffic flow analysis or other internal purposes. Chargy has a legitimate interest in producing these reports in order to improve the quality of service provision.
(A) Personal identification information
Receive and store any information obtained through the provision of services that allows the User to be personally identified, contacted, or other persons to be identified.
The data collected from the User includes:
Complete current registration information, consisting of name, surname, email address, User password, date of birth, telephone number, gender, age, and country of residence. Any data that the User provides about themselves or others when sending an email to Chargy, communicating with technical support, or directly with Chargy. Information related to or connected to a social media account that the User uses to register or log in to the Application or Website. For example, when the User associates their Facebook account with the Application, Chargy will have access to their public profile, friend list, and email address. If the User registers or logs in with other social media accounts, such as Instagram, Twitter, Gmail, or LinkedIn, Chargy may obtain similar information from those platforms. For this, the User must have accepted their corresponding terms and conditions. However, Chargy will only collect name, surname, email, and avatar from all that information. In relation to this information, the User should be aware that social networks have their own independent privacy policies, which inform about how they use the personal data of their users. It is advisable to review such privacy policies and the information that is collected, made public, and/or decided to be shared through them. Information regarding the User's debit card. Such data will be minimal and limited to part of the credit card numbers and the expiration date. Other information that the User may provide to receive free services, participate in a sweepstakes or contest, or make inquiries. (B) Passively collected electronic information
Both Chargy and the entities that provide services to it (the "Service Providers"), or the entities in whose facilities the Battery Sharing Stations are located, or the entities that use Chargy's services to advertise (the "Advertisers") and other third parties to whom Chargy communicates User data may automatically collect certain types of passive information when the User uses Chargy's services. For example, it may collect identifiers such as an IDFA (for iOS) or AAID (for Android), or the hardware model, operating system version, network provider, IP address, MAC address, and other unique device identifiers.
Usage information of the service will also be collected, such as the frequency of users using the service, pages, forms, or screens visited, session status, and similar data associated with your mobile device or the use of a charging unit.
(C) Location information through Chargy charging devices
This is information derived from GPS, WiFi, Bluetooth, compass, accelerometer, IP address, or posts containing location information. The User will share certain device location information in some cases:
when the Battery Sharing Stations are located within the facilities and in the private areas of our Clients, through the installed Beacons. The Application may use this type of information when the User uses certain location-based functions, such as the Compass (to locate the Battery Sharing Stations nearby), Map (to take you to the nearest Battery Sharing Station), and when the User shares their location with other Chargy Users; when the user removes the Powerbanks, in order to track and confirm whether they are returned to the Battery Sharing Stations or not. The entities, as well as all those third parties that use Chargy's services to obtain data from Users (our clients who may be referred to as "Partners" in this Privacy Policy), some of which operate Battery Sharing Stations or the facilities where Battery Sharing Stations are located, are not affiliated with Chargy and may have their own privacy policies and terms of use, which you may be asked to accept before using a Chargy charging device or that may govern the use of the information collected from the use of the services provided.
Likewise, we inform you that the collection and processing of some of this information is necessary for Chargy to be able to provide some of its services, in particular, the possibility of charging your mobile device with the Powerbanks.
Computer Vision in our devices
Computer Vision software is commonly used in the advertising sector. When Computer Vision technology is used, even if it is used for a Chargy campaign or its partners, a camera installed on our devices is enabled that can recognize basic characteristics of people (gender, height, age, etc.) who are looking at the screen to personalize interactions with the ad they are viewing. It can also capture apparent engagement with the ads we promote (such as the time someone looked at the ad).
If Chargy or our partners use Computer Vision technology, although Computer Vision systems use a camera, this does not mean that they use it as a recording medium, instead they use it as a visual sensor, so there are no images or videos that are saved or transmitted at any time. Personal data is never collected or processed in the operation of our software or our partners' software. The software used is subject to strict anonymization procedures, information security, and collection of anonymous and aggregated data without incurring in the collection of personal data.
At Chargy, we use Computer Vision software from third-party companies. We contract software providers that have undergone privacy impact assessments and have signed documentation committing to comply with applicable data protection legislation. Chargy does not attempt to identify you from Computer Vision software, it is not technically possible, nor are we interested in profiling people. Instead, we and our partners anonymize and aggregate any information into large-scale datasets to better understand the demographic reactions of the audience to the ads we promote, on behalf of our advertisers.
For what purposes and legitimization do we use your data?
Chargy always uses the data collected for the proper functioning of its Hardware and Software tools that we make available to our Clients for the following purposes:
Purposes necessary for the provision of the service and compliance with the contractual relationship:
Allowing the User to use the Application and the Website, manage the account and indicate where the Battery Sharing Stations are. Communicating User data to those Partners and/or Advertisers with whom Users interact, for example, with Partners who operate the Battery Sharing Stations where users charge their devices and, where appropriate, to the Advertisers displayed there. Allowing Chargy's Partners, through the myChargy website, access to a personalized control panel where they can view all the data generated by users at the Battery Sharing Stations. Communicating the data collected from users to other Chargy Partners. For marketing, promotion, and commercial prospecting or satisfaction surveys, of Chargy, Partners, and Advertisers, such as promotion of products and services through generic notifications or personalized offers from those Partners with whom the user has interacted at the Battery Sharing Stations.
Purposes based on legitimate interest:
Preventing fraud and other prohibited or illegal activities, and in general ensuring that Chargy complies with applicable laws. Chargy has a legitimate interest in trying to prevent potential fraud related to the provision of the service. Likewise, this data processing is necessary to comply with current law. Customizing, analyzing, evaluating, adjusting, and improving the services provided to meet the needs and expectations of Users, Advertisers, or Partners, as well as providing the User with functionality changes. All for the purpose of improving the quality of the services provided. Anonymizing or aggregating data for various purposes, such as market analysis or traffic flow analysis or other internal purposes. Chargy has a legitimate interest in producing these reports for the purpose of improving the quality of service provision. Conducting satisfaction surveys of Chargy's services among its users.
Purposes requiring consent.
If you accept this Privacy Policy, you may subsequently give consent for your data to be processed for other purposes. However, the User has the possibility to personalize their consent or, if applicable, at any time, modify, grant or revoke the consents granted:
Advertising and promotion. Our Clients may communicate with you to inform you about activities and advertising. Profiling. We will develop a commercial profile of the user, based on the information provided in order to communicate information according to their interests, for example, by sending them advertising related to their tastes, and/or about Partners or services similar to those with which they primarily interact. Communicate the existence of establishments, promotions or offers from Partners and Advertisers near the User.
How long will we keep your data?
At Chargy, we aim to keep the personal data provided only for the time necessary to fulfill the purpose for which it was collected and to determine the possible liabilities that may arise from the purpose for which it was collected.
Data retention criteria: they will be kept for the period established by Law, as long as they continue to use the Application and/or Website, as long as there is a mutual interest in maintaining the purpose of the treatment and when it is no longer necessary for that purpose, as long as the contractual relationship is maintained, as long as their deletion is not requested by the interested party and they must not be deleted because they are necessary for compliance with a legal obligation or for the formulation, exercise, and defense of claims. They will be deleted with appropriate security measures to guarantee the pseudonymization of the data or the total destruction thereof.
If the User revokes their consent or exercises the rights of cancellation or deletion, their personal data will be kept blocked at the disposal of the Administration of Justice for the periods established by law to attend to possible responsibilities arising from the treatment thereof. Subsequently, they will be deleted with appropriate security measures to guarantee the pseudonymization of the data or the total destruction thereof.
User Acceptance
By accepting this Privacy Policy, the User acknowledges having read and understood its terms.
Users must modify the data entered in the Application as they become outdated, being responsible, in any case, for the truthfulness and accuracy of the data provided at all times. Chargy reserves, where appropriate and without prejudice to other actions that may correspond to it, the right not to provide services or to deregister those Users who provide false or incomplete data.
Chargy assumes no responsibility for any damages or losses that may arise from the falsehood or inaccuracy of the data provided, for which only the User will be responsible.
Likewise, Chargy may disclose the personal data collected in specific cases where such transfer is established and required by applicable regulations, or when required by competent authorities.
Data communication
All data communications indicated below are necessary for the fulfillment of the purposes indicated above, or are carried out in compliance with a legal obligation:
- Authorities and security forces. Public authorities or law enforcement employees, if requested for the purposes indicated in this notice, if required by law or if necessary to protect our legitimate interests in accordance with applicable laws.
- Chargy Partners. n order to provide the User free access to the Chargy Points and to offers and services that Chargy and/or the Partners consider valuable to them, Chargy will share User data and any additional information collected at these points with the Partners operating at the facilities where the Chargy Points are located. For example, if the User uses a Chargy Point, the Partner operating it will receive or have access to the data of said User collected by Chargy and may send them an offer or promotion of their products or services.
- Service providers. Chargy may share User data with third parties that provide services on behalf of Chargy. These may include, for example (without limitation), storage service providers, data processing services, technical support and consumer services providers, surveying and market research service providers, and other service providers that help provide the User with the provision of services. Chargy contractually requires these external service providers to protect User data. These service providers do not have the right to use or transfer the data for any use other than providing services on behalf of Chargy.
Recipients of User Data
Chargy will communicate User data to various recipients, following the guidelines outlined above. The User may later inform themselves about the categories of recipients to whom they allow their data to be communicated and shared.
Likewise, the User through the Application (Settings>commercial information) can also customize the recipients and/or categories of recipients to whom they allow their data to be communicated and object to and/or withdraw consent with regard to those recipients with whom they decide not to share their personal data.
User data protection rights
At any time, and/or when they deem it appropriate, Users may exercise their rights of Access, Rectification, Cancellation, Opposition, Portability, and Forgetting by writing to the contact email that we have enabled for this purpose: info@chargy.com or by sending us a request by physical mail to calle Núñez de Balboa, 120 (28006 Madrid); attaching, in both cases, a copy of the passport or ID (data subject) and indicating expressly in the subject the request they wish to make: access, rectification, cancellation, opposition, portability, or forgetting.

Chargy reserves the right to modify this Privacy Policy in compliance with the applicable legislation at each time, in which case Users will be duly informed of the changes. Once the Privacy Policy has been modified, the User must accept it in order to receive Chargy's services. In case the User does not accept the Privacy Policy once modified, his data will no longer be processed by Chargy.
